Oct 4, 2004- H-1B Cap Reached for FY2005

The United States Citizenship and Immigration Service (“USCIS”) announced on the evening of October 1, 2004 that the H-1B cap has been reached. The cap applies to all new H-1B filings. This means that any new filings that are submitted after October 1, 2004 will be returned with the filing fee, and applicants will have to wait until April 1, 2005 to file new cases for an employment start date of October 1, 2005.
